Book Release - Bangsund on the Commercial Liens Act of Saskatchewan

November 30, 2023: I am pleased to announce the imminent release of my second book, Bangsund on the Commercial Liens Act of Saskatchewan. Published by the Office of the King’s Printer, the book is a resource for service providers, lawyers, judges, students, professors, and other business and legal professionals who transact and study in the Province of Saskatchewan. On some level, it is an annotated version of The Commercial Liens Act (CLA). However, statutory provisions are not analyzed in numerical order. Instead, content is organized according to concept, and statutory provisions are discussed in logical sequence.

In 2002, Saskatchewan became the first province to bring into force the CLA based on the model Uniform Liens Act, 2000 (ULA) promulgated by the Uniform Law Conference of Canada (ULCC). The CLA is a revolutionary statute that enables service providers to protect their trade credit with proprietary interests – liens – in the goods they enhance and preserve. In conjunction with The Personal Property Security Act, 1993 (PPSA), the CLA modernizes and rationalizes the law of commercial liens by standardizing rules for attachment, perfection, priority and enforcement.

All 2022 courses will be held at Alt Hotel, located in downtown Saskatoon along the scenic banks of the South Saskatchewan River.

I offer free enrolment in the Survey Course on the Personal Property Security Act (PPSA 1101) to articling students in the Province of Saskatchewan. Free Enrolment for articling students includes scheduled instruction and a pdf copy of the course materials, which will be circulated via email shortly after the event. For all other enrollees:

  • Base Enrolment includes scheduled instruction and a set of hard copy course materials, which will also be made available to enrollees in pdf format shortly after the event.

  • Deluxe Enrolment includes scheduled instruction, a set of course materials, and a copy of Bangsund on the Personal Property Security Act: The CCPPSL Model (Thomson Reuters, 2021).

Business Launch

January 6, 2022: I am pleased to announce that I have resumed legal practice under the business name Julius Erwin Consulting.

Background & Reinstatement of Active Membership Status

After earning a law degree from the University of Alberta in 2005, and practicing in the securities group at Blake, Cassels & Graydon LLP in Calgary, I returned to Saskatchewan in 2007 to focus on secured finance and debtor-creditor law. I was able to develop this specialization in my hometown of Langenburg under the tutelage of Donald Layh, now Justice Layh of the Saskatchewan Court of Queen’s Bench. In that year, 2007, I became a member of the Law Society of Saskatchewan, and remained actively engaged in practice across the three prairie provinces - Saskatchewan, Alberta and Manitoba - until 2011. Since 2011, I have chiefly focused on academic pursuits, but have maintained inactive membership status with the Law Society of Saskatchewan. I recently reinstated my status as an active member of the Law Society of Saskatchewan, effective January 6, 2022. I look forward to offering legal services as outlined below.

Julius Erwin Consulting

Operating as Julius Erwin Consulting, I will develop and teach courses for lawyers and finance professionals engaged in secured transactions and other types of commercial debtor-creditor activity. I will also undertake consulting work on a selective basis. 

Personal Property Security Act

I will begin by offering courses for legal practitioners who wish to gain general knowledge of Saskatchewan’s Personal Property Security Act (PPSA), an update and review of recent amendments to the statute, or specialized knowledge of advanced PPSA topics. Each enrollee will have the option of including, as part of the course enrolment price, a hard copy of my first full-scale monograph, Bangsund on the Personal Property Security Act: The CCPPSL Model (Thomson Reuters, 2021). Stay tuned for more details on these pending course offerings.

Commercial Liens Act

I am presently writing my second book, tentatively titled Bangsund on the Commercial Liens Act (Office of the King’s Printer, 2023), aiming for a release next summer. Once the book is in print I will develop, for the benefit of service providers and their legal representatives, a course on Saskatchewan’s Commercial Liens Act (CLA).

Customized Law Courses

I hold an education degree from the University of Regina and three law degrees (two from the University of Alberta, and one from Columbia Law School where I graduated first in class), have spent over six years in private practice, and have extensive experience developing and teaching courses in both university and industry settings. As a tenured Associate Professor at the University of Saskatchewan, College of Law, I teach and write on many commercial law subjects including, without limitation, personal and real property security law, sale and leasing of goods, liens on goods, suretyship, bills of exchange, transfers of securities and other financial assets, banking and financial services, clearing and settlement systems, and set-off.

Eligibility for CPD

I will aim to ensure that courses designed for practicing lawyers are eligible for credit under the Law Society of Saskatchewan’s rules for Continuing Professional Development (CPD). For any given course, CPD-eligibility is subject to review and approval by the Law Society of Saskatchewan.

Consulting

I will selectively undertake consulting work for persons and organizations in need of my expertise. Typical clients will include lawyers and law firms, governments, financial institutions, credit grantors, suppliers and lienable service providers. For the benefit of my clients, I aim to demystify the law, cultivate best practices and implement pragmatic, effective solutions.

I admire your strength and resolve in the face of a global pandemic, and regret not yet being able to acknowledge your accomplishments in person. Website Launch

March 15, 2018: It is fitting that JuliusErwin.com launches today. In ancient Rome the Ides of March commonly marked the deadline for payment of debt, a subject near and dear to my heart. Some regard the date as bad luck, and so it was for Julius Caesar in 44 BC. But for this Julius, it is no matter. I overlook these troubles, throw caution to the wind, and venture out on the Ides.
